A London bus driver's crisis

Ahead of the London bus drivers' strike on Friday, sections of the media are making ready to attack the strikers for exercising their right to claim a meager bonus for working during the unusually busy Olympic period. 
 
Meanwhile most London bus drivers are struggling to get by. We're reproducing below a synopsis by an advice worker who has been trying to help a London bus driver and his family deal with their horrendous housing crisis.

What you are about to read may sound like an exceptionally horrific tale of the recession. But the reality of Cameron's Britain is that stories like these are becoming increasingly commonplace. Thousands of families are unable to meet the costs of the bosses' crisis, thousands of children are going hungry or living in cramped conditions with thousands of parents struggling to feed them. Some of those parents will be going on strike this Friday.

"I have been working with the above mentioned family for many months trying to help them with their Homeless Persons' application to Brent Council. The family consists of Mr and Mrs Counihan and their 5 children under 15 years. Mrs Counihan was born and bred in Brent, Mr Counihan has lived there for over 20 years. The family have significant health problems: Mrs Counihan is significantly disabled and the youngest child suffers from autism. Mr Counihan works in Brent as a bus driver.

"In 2009 I assisted the family with their housing. Brent Council placed them in Priory Road NW6. The rent was £690 per week. The Counihans were responsible for £230 per week of this rent and Housing Benefit covered the balance. In January 2010 Mr Counihan inherited 9.5 acres of farmland in Ireland from his late father. The land is of poor quality and 4 acres of it is waterlogged most of the year. It has no planning permission and obtaining planning permission is not possible because of the inaccessibility of the parcel of land. The Counihans attempted to sell the land  but failed, not least due to the dire economic situation in Ireland. They realised that all they could do with the land was rent it to a local farmer for grazing purposes. 
 
"The land can support up to 20 cattle at a time. The going rate for land such as this is 1200 Euros per year and the Counihans managed to secure this sum. The Family immediately declared this extra income to Housing Benefit and Working tax credits. This resulted in an increase in their rental contributions and a reduction in their Working Tax Credits. They also lost their entitlement to free school meals and prescriptions. The family accepted these changes.

"In December 2011 they were contacted by the Housing Benefit Department for a review of their circumstances, again they declared their income from the land. This time however, they were told that as they had capital (the land) they were not nor ever had been entitled to housing benefit. Their benefit was immediately stopped and they were given a bill for £69,000. (Later reduced to £46,000). Unable to pay a rent of £690 per week on a bus driver's salary, the family became homeless.
 
"We assisted the family in making a Homeless Person's application to Brent Council in January 2012: Their application was the subject of 'Gatekeeping' and the family were directed to housing advice instead. The advice given was to get a mortgage. This was of no help as on their income and with 5 dependants, a mortgage was unobtainable.The family were also incurring a debt of over £1600 per month in their unaffordable accommodation. We assisted the family with an appeal against Housing Benefit's decision. 
 
"The Counihans received notice to quit their accommodation by 27/04/12. We again assisted the family in making a Homeless person's application. On this occasion, we had to accompany the family to the Council to avoid a repeat of the previous 'Gatekeeping'. We made it perfectly clear that any housing must be suitable and therefore affordable. The housing department were made aware of the Counihans' ineligibility for Housing Benefit. The Housing Department nevertheless provided temporary housing for the family which was neither suitable or affordable at a cost of £500 per week. 
 
"Despite having all the information necessary to make a decision on the family's housing application, no decision is forthcoming. We believe the housing department is awaiting a decision on the Housing Benefit appeal before making their own decision in the hope that they can find the family intentionally homeless. An Authority may not delay making a decision in the hope or expectation of a change in circumstances such as might reduce its duties (R V Ealing LBC Sidhu).
 
"Mr and Mrs Counihan have acted in good faith at all times and the dire situation they find themselves in is not of their making. The family are under considerable stress due to this appalling situation and three of the children are receiving medical care as a result. Mrs Counihan is suicidal and Mr Counihan is finding it very hard to cope."
 
We understand that Mrs Counihan is awaiting an urgent hip replacement at present, while every day she has to take her children to school in Kilburn from the family's accommodation in South Ealing.

Mass picket called at Ratcliffe this Tuesday

Things are warming up again on the Rank and File front. The combine meeting on May 23rd went well full report soon.

At the Liverpool Rank and File meeting it was decided to have a mass picket at Ratcliffe-on-Soar Power Station for our steward who is still suspended this Tuesday at 6am. Please try and get along its important we show solidarity and demand his reinstatement.

 

The protest at the Shard London Bridge is on this Wednesday again 30th May 645am. We also heard there was a walkout at Sellafield this week too thats the way to go, if they mess with us down tools!
 

Protests are being planned at Heathrow Terminal 2 Crown House site. There's a ring of steel at Heathrow making a protest close to the site difficult, we may have a Rank and File meeting there soon they badly need an elected steward or two so come on lads stick your neck out it's do or die.

Also there's a new pamphlet on the history of the Rank and File in construction from 1972 up to now. It costs £2 and £1 goes to the Rank and File fighting fund again let us know if you want a few copies.
 
Finally GMB are planning to take a high court action over blacklisting so anyone in GMB who may be blacklisted contact them asap. There were loads of GMB lads at Wembley Stadium, and other sites since then. Blacklisting was massive and is still going on you can be certain so let's fight it. Besna Highlights

A reminder of what the besna campaign was all about, we will be showing some highlights of the campaign.

Southern General Update

Progress has been made on site with Unite gaining recognition after meetings with Brookfield and Mercury. We have to organise on site now. If anyone is working on the site or if you know someone who is working on the site, could you please let us know.

Redundancies at Aberdeen Royal Infirmary

There is currently a redundancy situation with NG Bailey at Aberdeen Royal Infirmary amid fears of Besna backlash. Pay offs when agency guys are still on site are not on. Scott Foley has asked to meet NG Bailey over redundancy process, consultation, agency workers and selection matrix.

Blacklisting

Ian Davidson MP is hoping to raise the question of blacklisting at the scottish committee next week. If anyone has any information that could help him, could you cantact Scott Foley on 0845 345 0145 or 07810 157915. Please feel free to distribute this request.

Crown House

You may have already heard that Crown House has left the JIB/SJIB. Crown House is a legitimate target for Rank and File action. We believe that they currently have one contract in Scotland at Shotts Prison and have some more in the pipeline and we are trying to find out who the clients are. If anyone has other or more information on this, could you please let us know.

Contract Watch

Three contracts in Glasgow that we are keeping a close eye on to ensure national agreements are being adhered to are the Commonwealth Games sites, Buchanan Galleries and the New Concert Hall at SECC.

We said all along BESNA crew wouldn’t take the defeat lying down, well Crown House are meant to be pulling out of the JIB. Obviously that will affect those working for them greatly as they are bound to drop the hourly rate. We have asked Unite to confirm or otherwise and are awaiting their response.

What with this, the Combine, and so much more to discuss, the Rank and File are calling a ‘National meeting’. See below for the details...

Blacklisting latest

Last week there was a meeting re: ‘Blacklisting’ held with unite. Two Blacklisted Support Group [BSG] members met with Unite officers and the union lawyers. We believe the solicitors Guney Clarke Ryan have now got the insurance cover against individual cost should we lose the case in place.

We will try and get BSG to do a report back from the meeting. Cheers for all your hard work BSG.

Steve Acheson has not worked for 4 years due to Blacklisting what a scandal! Why is this being allowed to continue unchallenged by Unite? Please raise this at your branches and write to AGS Gail Cartamail, demanding Steve is given a job as electrician in the industry. Protest update

There was a good turnout at the Shard last week on May Day, but from this week we get back to the regular Wednesday slot meaning Wednesday 9th May at 6.45am at ‘The Shard’.

Why me/us?

Jerry Hicks' inspiring election campaign was run on a shoestring budget that confounded the many tens of thousands (or even £100,000s) spent by the other candidates.

There are tens of thousands of Unite members who want to see a democratic union working in their interests, and the
Grassroots Left is the volunteer-run group that is standing up for them.

We have a small but dedicated group of volunteers working hard to keep those grassroots members connected. This is an appeal for help to keep the
Grasroots Left doing what it does best.

Money is tight but we have a lot more work to do! And we need money for everything from leaflets to coach tickets to room rentals to you name it...

                                                                       
Progress

We want to set up rank and file committees in different sectors, that can run their own disputes if they need to, like we helped to do with the sparks, helping win the first major victory for the working class in this country since the start of the recession.

We want to continue to help get grassroots candidates elected into leading positions in Unite on the basis of our democratically agreed policies. We came a close second again winning 16,000 votes for
Lesley Mansell in the NEC elections for the LGBT seat.

We want to work on our media and become the first point of call for info on what's happening in Unite. We've made modest progress, by linking up our blogs into a single site, setting up a mailing list and a text messaging list.

Our conference even committed us to encouraging supporters in other unions with similar problems to set up their own initiatives! There's a world of work to be done.

And the
Grassroots Left is the only group in Unite calling for election of all officials and a union controlled by the members.

JIB talks sabotaged by Construction employers! Now 'Sparks may fly'?

First they offer a ‘paltry’ 1.5% then they try & pick our negotiating team

Earlier this week the Unite negotiating team with stewards and Rank and File members headed to Scotland to sit down and maybe start talks on ‘a new deal’.


But the cheeky b*****ds objected to one of our team, well we could have said we object to all your team, but we are reasonable people. Anyway fair play to Unite, they stood their ground and the talks never went ahead. SEE BOTTOM OF THIS UPDATE FOR A REPORT

The next meeting is due to be held in London in early May, what will happen remains to be seen.................. so watch this space.

The great agency rip off is not going away, in fact it’s getting worse. The 12 week rule is being ignored where you are meant to be taken on direct with same terms and conditions as company workers. 

So next week’s demonstration/protest is very important. Tuesday 1st May at 6.45 at ‘The Shard’ London Bridge Station, Mace site entrance in the bus terminus.

This will be on ‘International Workers Day’ so let’s try and make it a big one. Please support this demo which we intend to repeat every week until further notice.

URGENT Information: One of our best stewards has been suspended from Ratcliffe on trumped up charges of bullying. We all know who the real bullies are and it’s not Unite stewards.

UnionNews has learned that the first in-depth talks since the end of the so-called BESNA dispute last February have been suspended after the employers refused to negotiate with elected rank and file sparks representatives.

It is understood employers objected to the participation of a long-standing union activist who is known to have been blacklisted.

It comes as Unite officials have been attempting to negotiate an improvement on what is described as a ‘paltry’ 1.5% pay increase offered to construction electricians and other trades by one of the industry organisations.

Negotiators have so far rejected the offer, saying it would amount to a 15-month pay freeze for members.

Following the success of the seven month campaign against proposed cuts to pay, skills and safety levels by seven major construction industry employers, activists and Unite’s leadership insisted that rank-and-file reps should be part of the formal negotiating team in wide-ranging talks aimed at setting long-term agreements across the construction sector.

A frequent demand during the course of the dispute was that issues such as blacklisting, ‘bogus self-employment’ and the increasing use of agency workers and sub-contracting should be at the forefront of negotiations about the future of the construction industry.

In the face of forecasts of a fall in production of up to 3% across the sector this year, employers have continued to press for changes to working practices as well as cost-cutting.

The sector continues to account for some 7% of the UK’s overall economy, but has contracted by more than £20bn since the recession hit in 2008, according to industry figures.

Sources say talks on pay and other changes had reached a ‘crucial stage’ when the employers raised objections to the composition of the Unite delegation.

A further meeting is scheduled for early next week between Unite officials and executives from the construction companies.

Unite is insisting it will not accept any attempt by the employers to decide who makes up the delegation.

“These are elected branch officers and reps,” one official told UnionNews.

“They [the employers] have never objected before and we will not allow them to break up our team now.”
